The Terms and Conditions contain important information applicable to 360 Salvage Solutions online auction services. To access the online auction, you must first be a registered user and agree to be bound by these Terms and Conditions.

- To bid on the auction, you agree that you are a trader, and you agree that it is reasonable that the auctioneer may restrict and/or exclude liability as set out below. By purchasing a Lot from 360, you acknowledge and agree that as a trade buyer, consumer protection laws do not apply to any purchase and all terms, be it statutory or otherwise, are excluded to the fullest extent permitted by law. You acknowledge and agree that it is fair and reasonable for 360 to exclude, restrict or limit in all circumstances, our obligations and liability to you in respect of the Lots for sale on the auction on behalf of the seller.
- Personal and cherished registration numbers do not form part of the Lots unless expressly stated.
- Bidding is subject to registration, receipt of your registration fee and acceptance of the Terms and Conditions. You must complete the online registration process and pay the non-refundable subscription fee. You must then upload the relevant ID. This should be a passport or driving licence and a utility bill dated within the last three months and addressed to the registered premises.
- The fee for registration to bid on the online auction is £10 & VAT for a period of 6 months. 360 Salvage Solutions reserves the right to increase fees at any time without prior notice.
- One month prior to your subscription lapsing, we will contact you with details of any revised fee and remind you that your subscription is due for renewal.
- You are responsible for all actions undertaken on your user ID. Your user ID is not transferable, and you should not allow others to use it. The auctioneers reserve the right to terminate or suspend your account without prior notice if it is suspected that you have engaged in or have in any way been involved in or linked to any activity which is prejudicial to the auctioneer, the website or improper conduct of an online auction.
- Any auctions conducted, are subject to the Auctions-Bidding Agreements Act 1927, and Auctions Bidding Act 1969 where applicable. You can view these regulations via the HM Office Website.
- All images and/or descriptions are the copyright of 360 Salvage Solutions and may not be reproduced without written consent.
- By submitting a bid, a prospective buyer/bidder agrees to be bound by these Terms and Conditions. It is the responsibility of the buyer/bidder to check the Terms and Conditions or any special conditions relevant to the Lot each time they wish to place a bid or access the website to ensure that they are fully up to date with any changes that may take place.
- The auctioneers sell as agents for the seller unless they wholly or partly own any Lot in principle.
- Where an image is available, it merely provides a visual depiction of the Lot, and it should not be relied upon as providing an accurate or full depiction of the state and condition of the Lot at any time before, during or after the photograph is published.
- If you require specific additional information or additional images, these can be forwarded at a cost and at the discretion of each site, however you must contact the site at least 24 hours prior to the auction ending and have paid the £10 & VAT fee in advance of the images/information being forwarded to you.

- All Lots are sold with faults, imperfections and/or errors in descriptions. Buyers should satisfy themselves prior to sale, to the origin, description, suitability, age, durability, completeness, operability, mileage, state and condition of each Lot, and should exercise and rely on their own judgment as to whether the Lot accords with the description and/or suitability for the buyers’ purpose. Neither the seller, the auctioneers or their servants and agents are responsible for errors of description or for the genuineness or authenticity of the Lot. No warranty is given by the auctioneer, their servants or agents to any buyer in respect of the Lot and any express or implied statutory conditions or warranties are excluded to by the maximum extent permitted by law.
- Inspection of the Lot should be made prior to the consent of the auctioneers or the seller. This must be arranged directly with the individual site auctioning the said Lot. A physical inspection is at the site’s discretion and a fee of £10 & VAT per person is payable prior to this being arranged.
- No persons under the age of 16 will be permitted to site.
- PPE must be always worn whilst on site.
- The auctioneers have absolute discretion without giving any reason to refuse or reject a bid, to withdraw any Lot from the auction and in the case of a dispute, to auction any Lot again without prior notice. No responsibility is accepted by the auctioneers for any loss or costs incurred in respect of any action taken by the auctioneers under this condition.
- The seller/auctioneers may place a reserve price on any Lot. The winning bidder must meet or exceed the reserve price and have the highest bid. A bidder has a legal obligation to complete the transaction with the seller if at the end of the auction, the bidder has the highest bid, and it is accepted by the seller.
- By placing a bid, the buyer agrees to be bound by these Terms and Conditions, warrants and represents that he/it has the legal right to do so and that a successful bid will create a legally binding contract. The bidder has a legal obligation to complete the transaction with the seller if at the end of the auction the bidder has placed the highest bid, and it is accepted by the seller/auctioneer.
- You will be deemed to have tendered an Auto-bid by selecting or entering any amount in the appropriate box and confirming the price you are willing to pay for the Lot. Once the online auction starts, Auto-bid will competitively bid on your behalf until there are no competitors bidding against you or until the Auto-bid amount is reached. If your Auto-bid is surpassed, the system will stop bidding on your behalf. If any information changes on any Lots after you have submitted an Auto-bid, the system will automatically remove the Auto-bid, and you will be notified via email. Auto-bids may be automatically cancelled for any reason, with or without notice to you.
- The following non-refundable deposits will be deducted from your nominated card immediately after a successful bid is made online:
- Hammer prices £0 to £500 a non-refundable fee of £50 per vehicle will be deducted from your registered debit/credit card.
- Hammer price is £501 to £5000 a non-refundable fee equivalent to 10% of the hammer price per vehicle will be deducted from your registered debit/credit card.
- Hammer price is £5001 to £10000 a non-refundable fee of £500 per vehicle will be deducted from your registered debit/credit card.
- Hammer price is £10001 + a non-refundable fee equivalent to 5% of the hammer price per vehicle will be deducted from your registered debit/credit card.
- The following fees apply to Lots once a successful bid has been placed:
- Site fee £50 & VAT
- Export fee £50 & VAT (if applicable)
- Storage is due after 3 working days at a rate of £15 per day & VAT
- Late payment fee due after 3 working days at a rate of £25 & VAT
- Card issuers fee of 1.5% on UK Sales and 2.5% on EU sales is applied to all transactions and is non – refundable.
- Payment by bank transfer to 360’s dedicated bank account will not incur any charges other than the Management of Credit/ Debit card payments. Details of the bank account details can be found at the bottom of these Terms and Conditions.
- Hammer price £0 - £500 = £50 & VAT
- Hammer price £501 - £5000 = 10% of the hammer price & VAT
- Hammer price £5001 to £10000 = A fixed fee of £500 per vehicle & VAT
- Hammer price £10001 + A fee equivalent to 5% of the hammer price
- If a non-refundable fee cannot be debited upon a successful bid of a Lot, the bidders account will be suspended until such time as the Lot is paid in full. This must be within 2 working days. To lift the suspension, the bidder must register new card details. If a cost occurs, it is bearable by the bidder. 360 Salvage Solutions will under no circumstances bear this cost.
- All outstanding payments must be made within 2 working days of successfully winning a Lot. Payments must be made by debit/credit card or by direct bank transfer. No cash will be taken at site.
- Lots will not be released from site until all payments are paid in full. The ownership of the Lot will pass to the buyer once full payment is received. Risks on the Lot passes to the buyer as soon as the Lot is sold. You are strongly advised to ensure that adequate insurance is on the Lot since neither the auctioneer, the agent or the seller shall be liable for any loss or damage of any kind, whether it be negligent or otherwise, whilst any Lot is in their custody or under their control following sale.
- The buyer shall at their own expense take away the Lot purchased, no later than 3 working days following the sale but not before payment has been made and cleared funds have been received for the full purchase price. If the buyer fails to collect the Lot, the auctioneer may store it and a fee for the storage may be charged at the applicable daily rate & VAT.
- If the Lot is not paid and collected within 3 working days of the sale, storage will become due at the current rate at the time of the auction. There will be no exceptions to the rule and the auctioneer reserves the right to change this rate without prior notice. Any lot for which payment has been made but has not been removed from site and no agreement has been made to extend the storage provisions will automatically be resold at auction after 28 days. The proceeds of sale will be used to offset any outstanding debts for administration and storage charges.
- The buyer of any Lot is responsible for complying with all legal requirements as to the construction and use of the vehicle and for obtaining all certificates, permits or other authorisations necessary before the vehicle can be used on any road or highway. The buyer takes responsibility to comply with all applicable guidelines, regulations and legislation should a vehicle be broken for spare parts or be exported. Failure to do so may mean that a buyer will be banned from future bidding or purchases.
- If any Lot is not paid for in full and taken away in accordance with the above, or if there is any breach in conditions, the auctioneers shall in addition to any rights they may have, be entitled to retain any deposits made, terminate any registration and any further attempts to register or rescind the sale of any Lot sold to the buyer at that or any other auction.
- All Lots must be transported using vehicles designed for that purpose. The site reserves the right to refuse loading should recovery vehicles not be equipped to safely transport vehicles on the roads or public highway.
- The auctioneer has the right to resell a Lot at public or private auction. If there are any deficiencies in a subsequent sale, the auctioneer has the right to demand this from the buyer. The auctioneer also has the right to retain any other Lot from the same buyer at any auction and release only after full payment has been made. To reject or ignore any bids made by or on behalf of the defaulting buyer at any time in any future auction or cancel the defaulting buyer’s registration or obtain a non-refundable holding fee for accepting any future bids.
- The auctioneer does not guarantee that any bids submitted will be conducted fault free or will have continuous operability or service.
- To the maximum extent permitted by law, in no event shall the auctioneers nor any of its directors, servants, parents, affiliates, agents or other representatives be liable for any special, incidental, indirect or consequential damages. Including without limitation damage for loss of profits or any other pecuniary or other loss, whether arising in contract, tort, breach of statutory duty or otherwise arising from or in connection with the website or online auction, or the use, misuse or inability to use the website, in connection with these Terms and Conditions.
- Subject to all indemnities, exclusions and limitations set out in the Terms and Conditions, the auctioneers, directors, servants, parents, affiliates, agents or other representatives’ maximum aggregate liability under or in connection with the website, the online auction or these Terms and Conditions will under no circumstances exceed the amount of any sums paid or payable in accordance with the auctioneer’s schedule of administrative charges.
- You shall indemnify and keep indemnified the auctioneer, its directors, servants, parents, agents, affiliates and other representatives from and against all loss, damage, liability, cost and expense including legal fees on a full indemnity basis, suffered or incurred by the auctioneer resulting from or in connection with your breach of the Terms and Conditions.
- No agent or employee has the authority to change or agree to a variation of these Terms and Conditions.
- Except where expressly provided herein, these Terms and Conditions are not intended for, nor shall they be for the benefit of or enforceable by any third party and the provisions of Contracts – Rights of Third Parties Act 1999 are specifically excluded.
- Our current Privacy Policy covers our use of information that you provide. In using our services, you agree and acknowledge that you are bound by the terms of this Privacy Policy.
- Lots are offered for sale in the UK and these conditions shall be governed and constructed in accordance with English Law in English courts. All transactions to which these conditions apply, and all connected matters shall also be governed by English Law.
